Small Claims Court Paralegal In Mississauga, Brampton, Oakville and Toronto
Taking someone to small claims court?
Most people don’t like the idea of having to sue or being sued for damages in the small claims court, but when you’ve suffered damage or financial loss due to someone else’s negligence or willful acts, it is important to get the compensation that you need and deserve from a Small Claims Paralegal in Mississauga.
Since the law can be quite complicated in these matters, it is important to seek the advice of legal professionals. Balatidis Legal Services, a Small Claims Paralegal in Mississauga can provide you with small claims advice and help you identify the merits and weaknesses of your case to determine if it is worth your while to pursue it.
Our office will assist you with your Ontario small claims court matter for monetary and property damages up to $35,000.00, excluding interest and costs which may be awarded at trial. The small claims court has always been known as the “people’s court” hence why an individual or a company can self-represent themselves; however, here are some reasons why you should retain a small claims paralegal when dealing with a small claims court matter:
You won't have to worry about any important deadlines;
No longer have to deal with the other party or their counsel;
You will no longer have to complete legal forms which may be unknown to you; and
You will no longer have to attend court alone and speak before the judge: I will do that for you!
I will put in motion my many years of legal experience and knowledge before the courts so that you are represented in a professional and cost-efficient manner. Dealing with complex legalese from a small claims lawyer and the courts can be challenging, so let a small claims paralegal in Mississauga handle your matter.
What is the Ontario small claims court?
The Ontario Small Claims Court is a relatively quick system for settling claims of up to $35,000. Claims may include issues such as:
Debt Recovery including unpaid receivables;
Breach of Contract;
Contractor Disputes including the filing of Construction Liens; New changes were implemented as of July 1st 2018;
Insurance Subrogation Claims;
Negligence Claims including claims against Realtors;
Seizure and sale of land or property.
How Does Ontario Small Claims Court Work?
If you are owed money, your first step should be to consult with Balatidis Legal Services. If you do have a case, we can help you get the process started. In your application, you will have to state the reasons for your claim. Once the claim is issued, Balatidis Legal Services will serve a copy to the defendant(s) after which they will have 20 days to file a defence and possibly a counterclaim. If the defendant fails to do so, a default judgment could be rendered against them.
A Settlement Conference is held usually within 90 days of the defence being filed. This is an opportunity for both sides to obtain full disclosure and to give the parties an opportunity to settle. If no settlement can be reached, the case will then proceed to a trial during which any witness statements and evidence will be presented.
Every case is different and unique in its own way. As a result, we have determined that it would best benefit our clients if only upon reviewing the case can a fee be set and the type of payment arrangement for a specific matter. We are open and willing to work with our clients to meet their situation at hand by providing:
Hourly rate – We will charge you a specific amount for every minute we work on your file.
Block rate – We will set a flat fee to do specific tasks, for example preparation of defence or attendance at trial.
Contingency rate – We will set a percentage amount of which you will pay us if your lawsuit is successful or is settled in your favour.
It is important to note that clients are responsible for disbursements. Examples of disbursements include, but are not limited to court fees, process serving and photocopying.
