What is the Ontario small claims court?

The Ontario Small Claims Court is a relatively quick system for settling claims of up to $35,000. Claims may include issues such as:

How Does Ontario Small Claims Court Work?

If you are owed money, your first step should be to consult with Balatidis Legal Services. If you do have a case, we can help you get the process started. In your application, you will have to state the reasons for your claim.  Once the claim is issued, Balatidis Legal Services will serve a copy to the defendant(s) after which they will have 20 days to file a defence and possibly a counterclaim. If the defendant fails to do so, a default judgment could be rendered against them. A Settlement Conference is held usually within 90 days of the defence being filed. This is an opportunity for both sides to obtain full disclosure and to give the parties an opportunity to settle.  If no settlement can be reached, the case will then proceed to a trial during which any witness statements and evidence will be presented.

Fees

Every case is different and unique in its own way. As a result, we have determined that it would best benefit our clients if only upon reviewing the case can a fee be set and the type of payment arrangement for a specific matter.
